EVENT TERMS & CONDITIONS OF ATTENDANCE AND PARTICIPATION

By registering for and/or attending Floxsie Virtual (“the Event”) provided by Floxsie™ (“the Organizer”), you agree to be bound by and comply with the following Terms and Conditions, which form a binding contract between you and the Organizer:

1. Participation
Your payment and registration entitle you to access to the Event for which you have registered. Any and all other costs associated with your attendance shall be borne solely by you, and the Organizer shall have no liability for such costs.

2. Nondiscrimination Policy
Floxsie™ does not and shall not discriminate on the basis of race, color, religion (creed), gender, gender expression, age, national origin (ancestry), disability, marital status, sexual orientation, or military status, in any of its activities or operations. These activities include, but are not limited to, hiring and firing of staff, selection of volunteers and vendors, and provision of services. 3. Content of the Event
The speakers, exhibitors, and sponsors at the Event are solely responsible for the content of their presentations, marketing, and/or advertising. You agree to hold the Organizer harmless from any losses sustained by you or harm caused to you resulting from that content. The views expressed by any event attendee, speaker, exhibitor, or sponsor are not necessarily those of the Organizer. During the Event, you may be invited to make contributions via text message/chat and the like. By making such a contribution, you hereby grant the Organizer an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such contribution for any purpose. You acknowledge and agree that the Organizer, in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, special guests, hosts, vendors and time.

4. Prohibited Conduct
Use of obscene language and any other abusive or intolerant behavior is not allowed. You acknowledge and agree that the Organizer reserves the right to remove you from the Event if the Organizer, in its sole discretion, determines that your participation or behavior creates a disruption or hinders the Event or the enjoyment of the Event content by other attendees.  All Copyrights are reserved by the Organizer, speakers, exhibitors and sponsors, as the case may be.

5. Cancellation and Refund Policy
No refunds will be provided for cancellations.

6. Use of Personal Information
The Organizer is committed to data privacy and protecting your personal information. Your personal information (e.g., name, address, email address, billing information, etc.) will be utilized to organize and administer the Event. In addition, the Organizer may use your personal information in the future to inform you about upcoming events that may be of interest to you. The Organizer will not disclose your personal information to any third party without your consent except where required to do so by law.

7. General
These Terms and Conditions shall be governed by and in accordance with the laws of the State of New York. Any legal action of whatever nature brought by you shall be commenced or prosecuted in the state and federal courts located in Dutchess County, New York. If the Organizer is prevented from carrying out its obligations as it pertains to the Event you registered for as a result of any cause beyond its control, or such Event cannot be conducted because of a software or issue with the hosting platform or due to acts of God, strikes, labor disputes, government requisitions, restrictions or war or apparent act of war, terrorism, disaster, civil disorder, epidemic or pandemic, curtailment or restriction on transportation facilities, or any other comparable calamity, casualty or condition (collectively a “Force Majeure”), the Organizer shall have the right to immediately terminate the affected Event without liability and shall be relieved of its obligations to you. If the affected Event is terminated due to a Force Majeure occurrence before the start of the Event, then the Organizer will reschedule the affected Event and your registration fee will be applied to the rescheduled Event.
